Safety News Briefs - Worker Who Tested Positive For Cocaine Was Illegally Terminated

Worker Who Tested Positive For Cocaine Entitled To Back Pay and Fees

An employee who was fired after testing positive for cocaine use is entitled to back pay and attorney fees because the drug testing was not done following a workplace accident.  Iowa law permits an employer to conduct a drug test when investigating workplace accidents that lead to injuries.  The employee had been diagnosed with carpal tunnel resulting from repetitive work tasks, but this was not considered by the court to be a workplace accident.

OSHA Vows to Improve Whistleblower Treatment

Occupational Health and Safety Magazine reports that, "According to a recent study conducted by OSHA, there is room for improvement in the way many states handle whistleblower discrimination."

The Federal Annual Monitoring Evaluation (FAME) report revealed that incidents of discrimination involving workers who report health or safety issued in the workplace have been improperly handled in many states.

Arc Flash Safety Through Proper Maintenance And Testing

An article by Joseph Weigel in Plant Services magazine points out how electrical equipment often does not receive the maintenance it requires, but still continues to operate beyond its normal lifespan.  This can lead to complacency, undiagnosed equipment failure, and eventually a serious injury or fatality.

Criminal Case against Chemistry Professor Moves Forward

Last December the District Attorney’s office for Los Angeles County filed three criminal counts against the Regents of the University of California and Patrick G. Harran, Ph.D., who is a Professor of Chemistry and Biochemistry at UCLA. The defendants were each charged with three counts of willfully violating occupational health and safety standards, resulting in the death of Sheharbano “Sheri” Sangji was the research assistant working in the chemistry research laboratory.

The university has entered a settlement, but felony court proceedings are moving forward against the professor.

At the time of the accident Sangji was working with tert-butyllithium (tBuLi), a pyrophoric liquid. As she was drawing the liquid from a bottle into a syringe, the plunger came out of the syringe barrel, the tBuLi splashed on her clothes and set them on fire, and an open flask of hexane in the hood spilled and also caught fire. Sangji received severe burns on her torso, arms, and hands. Sangji had missed the lab safety training that UCLA provided to students only at the beginning of every quarter.

Workers' Comp Is A Major Fraud Area For Insurance Industry

Insurance claims fraud is exploding, according to a new report. The rate of questionable claims for the first time increased by 19 percent from 2009 to 2011 with workers' comp one of the largest fraud areas.

You can test positive for cocaine and not get fired?? What's wrong with this picture? The same people who are screaming about the need to increase OSHA enforcement and fines, to increase safety, are the ones who restrict testing for drug use that makes the workplace a lot less safe. What gives with this?
