Safety News Briefs - Court Decision May Change The Basis For OSHA Citations

Sixth Circuit Redefines Employee “Exposure” in Appeal of an OSHA Citation

In a decision issued at the end of 2012, the Sixth Circuit Court ruled that an employee does not actually need to be exposed to a hazard before an employer can be found in violation of an OSHA standard.

The Sixth Circuit Court covers Ohio, Michigan, Kentucky, and Tennessee.

This decision appears to be a departure from settled law. If this reasoning used to reach this decision is adopted by other circuit courts, employers could be liable for a host of imagined hazards instead of real world hazards.

New National and State Handbooks on Occupational Safety and Health

A small Maine publisher, Compliance Publications, has started publishing a guide to OSHA regulations and resources called the "National Handbook on Occupational Safety and Health" and has also begun publishing individual state guides.

Each state guide provides a complete overview of everything an employer must know and do to establish a safe and compliant workplace. At nearly 500 pages, each book provides a host of informational tools including safety assessment worksheets, a templated safety plan, sample forms, and step-by-step actions to achieve SHARP certification, a workplace safety designation that can lead to savings in liability insurance

It is so good to see that there is a company such as Compliance Publications is taking the initiative to create documentation that organizations across the country can use to establish safety programs. These guides will make it much easier for businesses to establish safety protocols, order the right safety equipment, and provide employees with the correct training for the job.
