Ontario Court More Than Triples Fine In Workplace Accident

The Canadian Criminal Code C-45 places criminal liability on corporations, and corporate representatives, that fail to take reasonable steps to ensure the safety of their workplace.

As the result of a workplace accident in which several workers were killed,
Metron Construction
pleaded guilty to criminal negligence that resulted in the deaths. A Metron Construction supervisor had had too many workers on a swing stage  and the swing stage collapsed.  An article published by Norton Rose Fulbright noted that:

"Following the incident, a toxicological analysis revealed that three of the four deceased, including the site supervisor, had marijuana in their system at the time of the accident."

The article goes on to report that an appeals judge increased the penalty from $200,000 to $750,000.  Read the complete article here, including the reasons for increasing the penalty.
